The allegations published in the press about the ATUC and its chairman are unfounded

We regret to say that some news sites have published biased articles that tarnish the activities of Azerbaijani trade unions, are far from the truth and do not refer to the facts. We state that the Azerbaijani trade unions have repeatedly responded to baseless statements in this regard, and all of them are completely untrue and slanderous.In response to comments in the press addressed to the Azerbaijan Trade Unions Confederation (ATUC) and its chairman, we state that the ATUC, based on its basic principles and the Law on Trade Unions, regulates labor relations, protects workers’ rights, organizes their social protection and leisure and conscientiously carries out activities aimed at establishing normal labor relations between employees and employees, eliminating possible conflicts, and protecting the legitimate interests of employees.
In the last three years alone, the ATUC has received a total of 434,107 appeals on various topics, 96% of which have been resolved. During these years, 410 people were illegally fired and reinstated by trade unions, and 1,257 people were prevented from being fired in accordance with the law. If we look at the statistics in general, we can see that trade unions have been the defenders of the rights of hundreds of thousands of workers.The claim of the ATUC chairman to sell the territory of sanatoriums and boarding houses and build a building is completely false. Thus, ATUC has 8 sanatoriums and one boarding house. 6 of the sanatoriums are open all year round and 2 are seasonal. Every year, thousands of trade union members are provided with referrals, and all conditions are created for their normal treatment. The ATUC chairman regularly visits trade union sanatoriums with the participation of media representatives, gets acquainted with the conditions on the spot, and is interested in how to organize treatment and recreation. It should be noted that no residential buildings have been built in the territory of any of these sanatoriums and boarding houses.Those who accuse the ATUC chairman of being elected chairman through undemocratic elections and kinship ties should not forget that the ATUC chairman has been working in trade unions since the 1980s.In 1991, he was elected chairman of the Trade Union of Motor and road workers.Manufacturing enterprises, factories, mills, where workers were united in trade unions, ceased operations and unemployment rose. At the same time, the leaders of the pioneering trade unions decided to abandon the Soviet-era AHIC and create a new democratic body.In December 1992, Sattar Mohbaliyev was elected chairman of a new body – the Azerbaijan Trade Union Confederation. The ATUC, which voluntarily unites the Nakhchivan Autonomous Republic and 26 sectoral trade unions, has been successfully represented in the International Labor Organization since 1992, and its opinions and suggestions are always taken into account. It has been a member of the International Trade Union Confederation since 2000 and the General Trade Union Confederation since 2004 and actively participates in events organized by these international organizations.

The people mentioned in the role of Mohbaliyev in the election of the chairman and other positions did not have any influence at that time. By the way, taking into account the international prestige of Azerbaijani trade unions, as well as the role and services of ATUC Chairman Sattar Mohbaliyev in the development of the world trade union movement, he was appointed Vice President of the International Trade Union Confederation in May 2014 and Pan-European Regional Council in December 2015. As for the membership fee paid for trade unions, we would like to inform you that the ATUC and its chairman have repeatedly informed journalists about the payment of membership fees and the direction in which they are spent. We reiterate that spending is monitored by trade union control and audit commissions. At the same time, reports on where the funds are spent are given at meetings, conferences and congresses. For this purpose, we bring to your attention a report: during 2020 and the first 6 months of 2021, the ATUC spent a total of 1,829,5091 manat in connection with the pandemic and the Great Patriotic War. Thus, during the 44-day war, the ATUC and its member organizations provided 10,260,605 AZN    to the Armed Forces Assistance Fund,  586,510  AZN   to the YASHAT Foundation,  600,000 AZN    to the Karabakh Revival Fund, in areas close to the Armed Forces and the frontline. 1,497,858  AZN   was transferred to residents living and suffering from the war, and  150,000  AZN   was transferred to trade unions of the Nakhchivan Autonomous Republic.

The ATUC provided financial assistance to the families of martyrs and veterans in the amount of 1123,800 manat. 6,278 families of martyrs and veterans received one-time assistance. 269 children from the families of 161 martyrs were taken into care. The ATUC, which was especially active during the pandemic, provided  9,925,985 AZN    to 98,507 low-income families and  6,500,762 AZN    to 92,254 people. In addition,  680,670  AZN   was transferred to the Coronavirus Support Fund and AZN 705,000 to the Heydar Aliyev Foundation’s Regional Development Public Union.In order to protect against infection, 1405285 units worth 1 450 149  AZN    were distributed among workers by purchasing protective equipment of more than 10 different names.We emphasize that none of the family members of ATUC Chairman Sattar Mohbaliyev holds a position in the Confederation. We also add that the ATUC chairman and his family members have no catering facilities, no business, no business partner or business advocate in foreign countries.

Accusing the ATUC of issuing referrals shows ignorance of the rules. We would like to remind you that every year hundreds of thousands of members of trade unions are provided with vouchers together with their families, and all conditions are created for their normal rest. It should be noted that these referrals are given to union members not by the ATUC, but by trade union committees operating in the workplace. A trade union member pays only 15% of the cost of the trip. One out of every 10 referrals given to union members by the first union is free. In this case, the ATUC’s activity in issuing referrals is only to ensure the quarterly distribution of referrals among the sectoral trade unions.As for the inactivity of the ATUC and its chairman, we declare that the body, which always focuses on the protection of the rights of its members, made more than 120 proposals on labor rights in the process of drafting the Labor Code in 1999, and most of them were taken into account. Also, in 1993-2003, the ATUC actively participated in the process of preparation and examination of about 50 normative acts. Sattar Mohbaliyev copes with his duties as a deputy with dignity. He is active in all discussions in the parliament, in the adoption of laws, makes speeches on the subject, meets regularly with voters, is interested in their concerns, takes measures in accordance with the law to realize their wishes. Sattar Mohbaliyev’s activity as both ATUC chairman and MP pays special attention to the families of martyrs, veterans, and veterans of the first and second Karabakh wars. This is clear from the statistics we have presented above, as well as in the press. It should be noted that Sattar Mohbaliyev’s brother Ahmad Mohbaliyev took part in the First Karabakh War, was martyred for special heroism and was awarded the “Flag of Azerbaijan ” order. In short, Sattar Mohbaliyev is also a martyr’s family.

For those who are unaware, we reiterate that trade unions are a public organization and that membership in the organization is voluntary. As its name suggests, the ATUC is a confederation, and the trade unions united there retain the right to operate independently. Therefore, the ATUC and its chairman can only give recommendations to member organizations.
